About No Win No Fee Personal Injury Claim
In July 1995 a change in the law allowed solicitors to enter into a conditional fee agreement with their clients for the first time this is referred to as “No Win No Fee”
A conditional fee agreement means that a solicitor is only entitled to be paid his legal fee if he wins the case. The solicitor’s payment is made by the losers or their insurance company and does not come out of any award of compensation.
In the event that a no win no fee case is lost, the solicitor will be unable to claim his fees from either the third party or his own client and must effectively write them off. This provides solicitors with an excellent incentive to win the case.
A victim of personal injury may not have to pay for any (disbursements) medical reports, medical records or court fees, however may still have to pay for Indemnity Insurance although this is not compulsory.
